The purpose of this website is to inform individuals that if you were employed by Defendants Lowe’s HIW, Inc. and/or Lowe’s Home Centers, Inc. as a Loss Prevention Manager at any time from July 5, 2008 through January 26, 2012, you could be entitled to benefits under a class action settlement. Additionally, if you were employed as a Loss Prevention Manager in New York from July 5, 2005 through January 26, 2012, you could be entitled to benefits under a class action settlement.
On January 26, 2012, the Court granted preliminary approval of a proposed settlement as set forth in a Class and Collective Action Settlement Agreement. If the settlement is granted final approval by the Court:
- this Lawsuit will be dismissed with prejudice, and Defendants Lowe’s Home Centers, Inc. and Lowe’s HIW, Inc. (“Defendants”) will be released from all claims that were asserted, or could have been asserted, in the Lawsuit including, among others, claims under the federal Fair Labor Standards Act (“FLSA”) and any corresponding state wage and hour laws;
- all members of the Plaintiff Class will be entitled to a settlement payment, assuming the members of the Plaintiff Class follow the procedure explained in the Notice, including submitting a Claim Form.
The Class Representatives and Class Counsel believe the proposed settlement is fair, adequate, and reasonable and in the best interest of the Plaintiff Class. This website informs you of the proposed settlement and its terms and your rights to participate in the proposed settlement.
