The purpose of this website is to inform you of your rights as they may be affected by a lawsuit if you worked as a Shift Manager at certain designated Avis or Budget locations after October 17, 2008 and have not already opted-in to this lawsuit or the Ravenell et. al. v. Avis Budget Car Rental, LLC and Avis Rent A Car System, LLC, Docket No. 08-CV-2113 (E.D.N.Y.)(SLT)(ALC) lawsuit.
The action is concerning claims by the Plaintiff that he and all other similarly-situated Shift Managers are non-exempt hourly employees, and therefore entitled to overtime pay for when they worked over 40 hours per week. ABCR and Budget contend that Shift Managers are properly classified as salaried exempt employees, exempt from the overtime provisions of the Fair Labor Standards Act. The lawsuit is in the United States District Court for the Middle District of Florida, and is called Espanol v. Avis Budget Car Rental, LLC, et al. No. 08-CV-944T30. Please note, the Court in this case has not decided who will win this case. The right to recover for Shift Managers has not been established at this point and is not certain.
